What’s the common point between “I bought an ice cream for 1 million $” “I think Earth is flat” and “I love going to vacation to Chernobyl” ? A bad taste of humor you could say. The answer here is that those three statements are false. What would happen you think if you wrote those false statements on Facebook or Twitter? Normally, the answer would be nothing. But if you are in Thailand, as soon the new amendment to the Computer Crime Act would become effective and the authorities find your statement false and dangerous to somebody; you could technically risk a 5-year prison sentence and a 100,000 baht fine.

The criminal court dismissed the case where “Toongkam Company Limited” filed a lawsuit of defamation by advertising pursuant to Section 328 of the Criminal Code and Section 14(1) of the Computer Act against the correspondents and the board of directors of Thai PBS after the station reported news regarding the environmental effects of the gold mining run by the aforesaid company in Loei Province. Amnesty International Thailand stated that such decision is a good sign for freedom of expression of the media in Thailand.   

This joint statement calls on mining company Tungkum Limited to immediately and unconditionally withdraw all criminal proceedings against Thai Public Broadcasting Service (Thai PBS) and four media professionals currently or formerly employed by Thai PBS.

Human rights lawyer Sirikan Charoensiri (also known as June) faces an unfair trial in a military court together with 14 peaceful student activists she legally represented in June 2015. If convicted, she could face up to fifteen years’ imprisonment.

The Supreme Court dismissed the case of Andy Hall, a British migrant worker rights activist, as per the indictment of Natural Fruit Co., Ltd. Mr. Hall stated that his lawyer suggested that there may be a false accusation and that he prepared to file a counterclaim.

Thailand’s National Legislative Assembly is considering amendments to the rights-restricting Computer Crimes Act (2007). Current proposed changes preserve the Act’s powers to violate the right to freedom of expression and the right to privacy including by enabling indiscriminate online surveillance and censorship.

Amnesty International, FiDH, Fortify Rights, ICJ and Lawyers Watch Canada urge Thailand’s National Legislative Assembly (NLA) to reject currently proposed amendments to the 2007 Computer-Related Crime Act (CCA) and to instead adopt amendments that would bring the law into line with Thailand’s obligations under international law, including its obligation to uphold the rights to freedom of expression, opinion, and privacy.
