The Special Prosecutor on Juvenile and Family Affairs have today indicted three children including Lapanaphat \u201cMin\u201d Wangphaisit, 18, and Benjamaporn \u201cPloy\u201d Niwas, 16, from \u2018Bad Students\u2019 and Khanaphot \u201cPhum\u201d Yaemsanguansiri, 16, from \u2018Free Students\u2019, for the violation of the Emergency Decree 2015 which carries an imprisonment of up to two years or a fine of up to 40,000 baht, or both as a result of their participating in a demonstrations at the Ratchaprasong intersection on 15 October 2020. Regarding this prosecution against youth, Piyanut Kotsan, Director of Amnesty International Thailand, has this to say; <\/p>\n\n\n
\u201c<\/span><\/span>Children and youth<\/span> should not be prosecuted for expressing their opinion peacefully to demand a reform of education and human rights. Thailand is obliged to <\/span>protect <\/span><\/span> <\/span><\/span>every<\/span><\/span> <\/span>peron\u2019s<\/span><\/span> rights, particularly <\/span>of<\/span> a child under 18 years who has participated in a protest as prescribed by the <\/span>International Covenant on Civil and Political Rights <\/span>(<\/span>ICCPR)<\/span> and the <\/span>Convention on the Rights of the Child<\/span> (CRC)<\/span> to which Thailand is committed. <\/span> <\/span><\/span><\/strong><\/p>\n<\/blockquote>\n\n
\u201c<\/span><\/span>In addition, the state has a <\/span><\/span>positive<\/span><\/span> obligation to protect the rights of the child<\/span><\/span>,<\/span><\/span> and<\/span><\/span> therefore<\/span><\/span> any action in a demonstration site <\/span><\/span>has to<\/span><\/span> be carried out with the assumption<\/span><\/span> that<\/span><\/span> there could be children there and how to protect them from any harm, including from the <\/span><\/span>operation<\/span><\/span> of the law enforcement officials. The authorities are also obliged to <\/span><\/span>avoid intensifying the <\/span><\/span>situation by refraining from abusing the <\/span><\/span>Emergency Decree<\/span><\/span> and weaponizing the arrest and the law to intimidate the protesters.<\/span><\/span>\u201d<\/span><\/span> <\/span><\/span><\/strong><\/p>\n<\/blockquote>\n\n\n
Amnesty International reiterates that Thailand has an obligation per international treaties to protect the right to freedom of expression and peaceful assembly including the ICCPR and the protection of the rights of a person younger than 18 years who participates in a public assembly pursuant to the CRC since Thailand is bound by both treaties. <\/p>\n\n\n\n
